Terms of Service
Last updated: 2026-09-29
These terms apply when you use TierHawk, a pricing-change monitoring service at tierhawk.com. In these terms, “we” and “us” mean the operator of TierHawk (named in section 12). By creating an account or paying for a plan, you agree to these terms. If you do not agree, do not use the service.
1. What TierHawk does
TierHawk fetches publicly accessible pricing pages on a schedule, compares what it reads against the previous version, and emails you when it believes something changed. Comparing versions may involve automated analysis by a third-party AI model. We read pages as an automated client, we identify ourselves in the request, and we honour robots.txt.
2. Automated data — please read this part
This is the section that matters most. Everything TierHawk shows you is produced by software reading third-party web pages, and that process can and does go wrong:
- A change may be missed entirely — pages change without notice, may block automated access, may only render in a browser, or may serve different content depending on the region the request comes from.
- A change may be reported incorrectly — for example a page showing a different currency, a cookie banner, or a marketing experiment can look like a price change when nothing about the offer changed.
- Summaries are generated by an AI model and may be inaccurate, incomplete, or misleading.
- We do not control the sites we monitor and we do not verify their content.
TierHawk is an information service, not financial, legal, or business advice, and not a substitute for reading the source page yourself. Do not make pricing, contractual, or budgeting decisions in reliance on TierHawk alone — always confirm against the vendor’s own page before acting.
3. No warranty
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, timely, or free of errors.
4. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for the cost of substitute services. Our total aggregate liability for all claims relating to the service is limited to the amount you paid us in the three months before the claim arose.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, and nothing here affects mandatory consumer rights you have where you live.
5. Your account and acceptable use
- You need a working email address; we sign you in with a one-time link instead of a password.
- Keep your account to yourself. You are responsible for activity that happens under it.
- Do not use TierHawk to break the law, to overload third-party sites, or to work around access controls. We rate-limit how often we fetch a page and we do not attempt to bypass CAPTCHAs or other bot protections.
6. Third-party content
The pages we monitor belong to their owners. We show you facts such as plan names, prices, and limits, and short excerpts of the text we read, so that you can verify our reading — not as a substitute for the original. We claim no rights in that content. Vendor names and logos remain the property of their respective owners and are used only to identify the pages you asked us to watch.
7. Plans, billing, and refunds
- Paid plans are sold through Creem, a third-party payment provider acting as our merchant of record. Creem is the seller of record for your purchase, and its name (not TierHawk’s) will appear on your card statement.
- Subscriptions renew automatically until you cancel. You can cancel at any time and keep access until the end of the period you already paid for.
- Refunds are handled by Creem under its buyer terms. If something is wrong with a payment, contact us first and we will help sort it out.
- We may change plan prices. If we do, we will tell you before your next renewal.
8. Changes to the free plan
The free plan has limits (how many competitors you can monitor and how much history you can see). We may change those limits, and we will describe the current ones in the app.
9. Ending the service
You can stop using TierHawk at any time and ask us to delete your workspace. We may suspend or end your access if you breach these terms, if the law requires it, or if we discontinue the service. If we discontinue a paid plan, we will refund the unused part.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will notify you by email or in the app before it takes effect. Continuing to use the service after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of the People's Republic of China, and disputes will be resolved exclusively by the courts there, without affecting any mandatory rights you have as a consumer in your own country.
